The owners of the cottage, Croabh Haven Self Catering,/we/our/us) makes sales of cottage holidays via www.croabhhavenselfcatering.com (the "Website"), using the booking form that is available within the cottage, via email requests and takes bookings direct and in person.
Any person wishing to book a holiday via any of these methods (referred to as "you/your") acknowledges that such booking is made subject to our terms and conditions set out below.
You may only request a booking if you agree to these terms and conditions. By requesting a booking you are deemed to have accepted these terms and conditions as governing your booking.
This does not affect your statutory rights as a consumer.
We reserve the right to change these terms and conditions at any time. Any such changes will take effect immediately when posted on the Website, at the cottage, or otherwise brought to your attention. It is your responsibility to read the terms and conditions each time you request a booking and any such request shall signify you have accepted to be bound by the latest set of terms and conditions.
1. Booking Confirmation
When you wish to place a booking for a holiday ("Booking Request") with us, you will complete a booking form (either by phone, by email, on the booking form or at the cottage). It is your responsibility to provide us with the correct information. If you have made the Booking Request via the telephone, we will read back your details to you. You will be responsible for the Booking regarding any input errors.
If you have made the Booking Request via email from the Website we shall send a response email to you as an order acknowledgement of the Booking Request with a booking reference number.
For all other Booking Requests we process, we shall issue written confirmation accepting your Booking Request with a booking reference number.
Once Croabh Haven Self Catering has issued such written or email confirmation it shall have entered into a contract with you.
By making a Booking Request you warrant that you have the authority of all persons in your party to book on their behalf, accept these terms and conditions and that you will indemnify Croabh Haven self catering and keep Croabh Haven Self Catering fully and effectively indemnified against all loss and damage arising directly or indirectly, from any act or default by yourself or any person or animal accompanying you.
Bookings are not transferable.
In addition to these terms and conditions, there may be specific rules to be adhered to. These will, where applicable, be prominently displayed in the cottage.
2. Services, Features and Facilities
Apart from your holiday accommodation none of the features, facilities or services referred to in the Website (e.g. bike hire, pony trekking and boat hire etc) are provided by Croabh Haven Self Catering or its agents (unless otherwise stated). We shall not have any responsibility for loss, damage or injury in relation to these features, facilities and services which we do not provide.
Information about features, facilities and services at your holiday, is, to the best of our knowledge and belief, accurate at the time of publication of the Website, but some of these features, facilities and services may not be available at the time you take your holiday.

3. Payment
If you place your booking more than 12 weeks prior to the start date of your holiday, we will request a deposit of £100 (rather than full payment). The balance of the full payment will be due 12 weeks prior to the start date of your holiday.
For all bookings received within 12 weeks of your holiday start date, full payment is due at the time of booking.
Non-receipt of the full accommodation charge by the due date may be treated by us as a cancellation of the booking and you will forfeit the total cost of your holiday.
The booking will then be subject to the cancellation procedure outlined in Condition 4.
4. Cancellation
If you want to cancel your booking you must notify us as soon as possible and confirm in writing. Provided the cancellation is received not less than 12 weeks before the start date of the holiday, only the deposit will be forfeited. If we receive less than 12 weeks' notice, you will be liable to pay the total cost of the holiday. See our Cancellation Cover terms and conditions.
Our customers visit our cottage to enjoy the peace and tranquility of the area. If anyone does not respect this, we reserves the right to ask them to leave the proprerty at any time. If you are asked to leave under these circumstances, no monies will be refunded.
5. Amendments
If you want to amend your booking you must notify us as soon as possible. Amendments to your booking can be made up to 12 weeks prior to the start date of your holiday and are subject to availability and to a £20 administration fee.
Should you wish to transfer your booking to another date, we will use our reasonable endeavours to satisfy your request wherever possible, but shall be under no obligation to do so.
6. Pricing
The prices for accommodation are based on holiday start dates unless otherwise stated. Prices include VAT at the current prevailing rate where applicable.
Whilst we will make every effort to ensure that our prices remain unchanged, they may be amended at any time prior to payment of the final balance.
In such circumstances, you may cancel your booking by giving notice in writing, by Recorded Delivery, within 14 days of the issue date printed on your invoice, and we will refund all monies paid in respect of the booking.
7. Occupants
The maximum number of people occupying your accommodation must not exceed the number agreed at time of booking. This does not include infants under the age of 2.
Single sex groups are welcome. Please make us aware if you are an all male or an all female group before booking.
8. Dogs
Well-trained dogs are welcome, subject to payment of the appropriate supplement. They must be kept under proper control and must not be left on their own in the cottage.
All traces of their presence must be removed before you leave. Dog owners are reminded that farmers have the right to shoot dogs worrying sheep. Please do not allow dogs to sit on the beds or the furniture.
9. Arrival and Departure
Arrival time is after 4.00pm on the agreed date of arrival. If you are likely to arrive late, please let us know.
Please note that arrival may be accommodated from 12.00 noon. Please contact us 7 days before your arrival date if you wish to organise an early arrival.
Your booking ends at 10.00am on your agreed date of departure. A late departure (up to 2.00pm) may be arranged (subject to availability and a £15 late departure fee).
10. Your Responsibility
The accommodation must be left in a clean and tidy condition. Please make us aware of any breakages or damage caused during your stay.
Croabh Haven self catering shall be entitled to charge you for any costs or expenses it incurs as a result of any breakage or damage or a failure by you to leave the accommodation in a clean and tidy condition.
11. Cancellation and breakage cover
We advise customers to take out cancellation and breakage cover.
12. Mobility Difficulties
Please make enquires as to suitability before booking.
13. Complaints
We are most concerned that you have an enjoyable holiday. Should you nevertheless have cause for complaint, please contact us immediately and we will advise you of our complaints procedure.
14. Promotions and Special Offers
Promotions or discounted offers are provided at the discretion of Croabh Haven Self Catering. All offers are subject to availability and may be withdrawn at any time.
15. Third Parties
Reference to any products, services processes, trade names, trademarks or other information of third parties does not imply or constitute an endorsement, sponsorship or recommendation by Croabh Haven Self Catering.
Links to other services not operated by us are solely for your convenience. Croabh Haven Self Catering are not responsible for any products, services, processes, trade names, trademarks or other information provided by third parties.

17. Sharing Information
Information is shared with a) our bank and b) involved third parties, eg. Insurance, credit cards etc. When paying by credit or debit card we pass your card details to our bank for authorisation of the transaction and for payment.
We do not disclose your details to any other person without your consent unless there is an emergency situation that requires it or we are legally required to do so.
18. Disclosure
By agreeing to these terms and conditions you are agreeing to abide by all of our policies which are available at our site.
19. Liability
Unless required by law, we will not be liable to you for any loss of profit, loss of business or loss of goodwill or for any indirect or consequential losses whatsoever and our maximum liability shall be no more than to refund the amount paid by you for the holiday.
We shall have no liability to you for any failure to perform any of our obligations under the contract if and to the extent that the failure is caused by act of God, governmental restriction, condition or control or by reason of any act done or not done pursuant to trade dispute, shortages of labour or materials or breakdown of machinery or any other matter (whether or not similar to the foregoing) outside of our control.
The owners shall not be held responsible or liable for any accident,loss or mishap occuring whilst on or using the premises, or for any illness or injury arising from any cause whatsoever.
No liability is accepted by the owner for loss or damage to baggage,motor etc. however caused.
If the cottage becowmes unavailable or unsuitable for rental for any reason whatsoever, the owners liability shall be limited to the amount of rent paid
The owner reserves the right to refuse entry to the cottage to anyone who in the opinion of the owner is not suitable to take charge of the cottage.
The owner reserves the right of access to the property at all reasonable times.
20. Third Party Rights
No person (except you and us) shall have any rights pursuant to the Contract (Rights of Third Parties) Act 1999 (the "Act") to enforce any of these terms and conditions. Any right or remedy of a third party which exists or is available apart from the Act is not affected.
21. Governing Law
These terms and conditions shall be governed and interpreted exclusively according to the laws of Scotland.
We and you agree to submit to the exclusive jurisdiction of the Scottish Courts in relation to any matters of dispute arising out of or in connection with these conditions provided that we may, at our option, take proceedings in the courts of the state or country in which you are domiciled including action to obtain any remedy (including injunctive relief).
The contract between us shall be concluded in the English language.
